Westermill Farm Campsite
In-ground and Portable Fire Use Waiver of Liability

PLEASE READ CAREFULLY BEFORE SIGNING

This waiver releases Westermill Farm Campsite (“the Campsite”) from all liability related to injuries or damages that may occur as a result of using in-ground or portable fires at the Campsite. By signing this document, you acknowledge and accept the risks associated with these activities.

1. Assumption of Risk

I, the undersigned, understand that the use of in-ground and portable fires, including fire pits, barbecues, stoves, and braziers, carries inherent risks. These risks include, but are not limited to, burns, property damage, smoke inhalation, and other injuries. I voluntarily assume all such risks associated with the use of these fire systems.

2. Waiver and Release

In consideration of being permitted to use the Campsite’s facilities and equipment, I agree to release, waive, discharge, and hold harmless the Campsite, its owners, agents, employees, and volunteers from any and all claims, actions, damages, liabilities, and expenses, including but not limited to, claims of negligence resulting in personal injury, property damage, or death, arising out of or in any way connected with the use of in-ground or portable fires.

3. Indemnification

I agree to indemnify and hold harmless the Campsite from any claims, demands, or causes of action brought against the Campsite by any other party due to my use of in-ground or portable fires, including any legal fees and costs.

4. Compliance with Safety Guidelines

I agree to comply with all safety guidelines and instructions provided by the Campsite related to the use of in-ground and portable fires. I acknowledge that failure to follow these guidelines may result in injury or property damage for which I assume full responsibility.

5. No Waiver of Legal Rights

I understand that this waiver does not release the Campsite from liability for gross negligence or wilful misconduct. I further acknowledge that this waiver does not affect any rights I may have under applicable laws that cannot be waived.

6. Acknowledgment of Understanding

I have read this waiver of liability, fully understand its terms, and sign it freely and voluntarily. I understand that I am giving up substantial rights by signing this document and agree to do so as a condition of using the Campsite’s in-ground and portable fire facilities.
